Fatima worked as a personal carer on a permanent part-time basis in an aged care facility for just over four years.

Fatima sustained an injury in the workplace and went on Work Cover. Following an operation she returned to her job with adjustments made on account of her impairment. Fatima remained working for a period of 2.5 years’ with these adjustments in place.

In February 2019, Fatima was stood down without warning and with no pay; pending a decision about her ongoing employment at the facility. Almost a month later in March, Fatima was advised by registered post that her employment had been terminated effective immediately.

The dismissal was harsh, unjust and unreasonable. There was no valid reason and no due process; after over four years of employment Fatima was not even given an opportunity to attend a face-to-face meeting with management.

Working Women Queensland negotiated 18 weeks wages before matter was to proceed to a Fair Work Commission Hearing.
